Antitrust & Mergers

German competition authority bans Amazon from interfering in marketplace sellers' pricing. In addition to the prohibition, the authority ordered the disgorgement of economic benefits gained through the abusive practices, currently set at €58.8m.

     

Media

The European Commission informed TikTok of its preliminary view that the company is in breach of its obligation to assess and mitigate risks that the addictive design features of the platform pose for the physical and mental wellbeing of users, including minors. Accordingly, the Commission asked TikTok to disable addictive features such as infinite scrolling, implement screen-time breaks, and adapt its recommender system.

Digital Economy

The draft CSA2 would introduce a cyber posture certification scheme enabling NIS2 entities operating in multiple EU member states to demonstrate compliance with the directive's security risk-management obligations. EU certification schemes would be developed by the EU cybersecurity agency (ENISA) within 12 months of the European Commission issuing a request. 

Digital Economy

Through amendments to the Cybersecurity Act, Poland transposes the NIS2 Directive and introduces procedures for phasing out products, services and processes from high-risk suppliers (HRS). The national law overlaps with the draft Cybersecurity Act 2, which would empower the European Commission to restrict HRS in critical sectors at EU level.

     

Telecoms

The Commission considers that the Romanian regulator did not provide sufficient evidence of significant barriers to entry that would justify the imposition of wholesale market regulation and is concerned that regulating could discourage future investment across the EU.

The DNA proposal retains the existing approach to symmetric access obligations for in-building wiring and, where necessary to address local bottlenecks, beyond the first concentration point, while introducing a new power for NRAs to impose such obligations on their own initiative. Symmetric access will also facilitate copper switch-off by requiring fibre operators to connect end users in affected areas.

     

Global Trends

Cullen International's updated benchmark analyses different aspects of social media regulation across 13 jurisdictions. The benchmark describes the regulatory framework including licensing requirements, local representation requirements and ownership restrictions on social media platform providers, as well as rules governing illegal and harmful content, such as content sharing restrictions and safe harbours.
