Antitrust & Mergers

Facing an EU antitrust investigation and potential interim measures, Meta decided to allow once again third-party AI chatbots to access and interact with users on WhatsApp in the European Economic Area. However, this will be subject to a per-message fee.

     

Media

The Court of Justice of the European Union ruled that national measures limiting or restricting broadcasters' access to radio frequencies could potentially interfere with the right to freedom of the media associated with freedom of broadcasting.

Telecoms

The Gigabit Infrastructure Act (GIA) seeks to reduce the cost of deploying very high capacity networks in the EU, replacing the Broadband Cost Reduction Directive. As a regulation, it applies directly across member states but allows countries to adopt additional measures beyond its minimum requirements. Cullen International's new benchmark examines how member states have implemented key options under the GIA, including access to existing infrastructure, coordination of civil works, permit-granting procedures, and the introduction of a fibre-ready label for buildings.

Digital Economy.

Five member states have not yet transposed the NIS2 directive, which aims to establish a high common level of cybersecurity across the EU. The deadline for member states to adopt national legislation transposing the directive was 17 October 2024.

     

Sustainability

The European Commission proposed to extend its "made in the EU" criteria to vehicle components produced in countries outside the EU if those countries have a free trade or customs union agreement with the EU. The "made in the EU" condition was proposed in the Automotive Package, applying to: small electric cars, low-carbon steel used in making cars and vans, and zero or low-emission company vehicles benefiting from member state financial support.

     

Postal

The UK government's Department for Business and Trade decided to retain the current minimum network size and geographic access requirements and provide more than £500m in state funding to the Post Office. These were some of the decisions and actions published in the Department's response to its consultation on the future of the Post Office.

     

Global Trends

The Nigerian Communications Commission (NCC) issued its revised Internet Code of Practice in February 2026. The code is binding on all internet access service providers (IASPs) in Nigeria. The revised code preserves the existing net neutrality framework but expands the rules for IASPs by adding obligations on child online safety and AI notification requirements. The code also strengthens NCC's supervisory powers over digital platforms providers.

     

Spectrum

The Colombian spectrum regulator, ANE, is consulting on its 2026–2030 spectrum master plan and the regulatory agenda for the 2026–2027 period, outlining reforms on IMT planning, spectrum caps, satellite D2D connectivity and award procedures.
